Welcome to SocialBotify. These Terms of Service ("Terms") govern your use of the SocialBotify platform, website, and services (collectively, the "Service") operated by SocialBotify ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using SocialBotify, you confirm that you are at least 18 years old and agree to comply with these Terms. If you do not agree, you must not use the Service.

2. Account Registration

To use SocialBotify, you must create an account by providing accurate and complete information. You are responsible for:

  • Maintaining the security of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

3. Service Description

SocialBotify is an AI-powered social media management platform that helps you create, schedule, and publish content across multiple social media platforms. The Service includes:

  • AI-generated content creation using your brand voice
  • Content scheduling and automated publishing
  • Image sourcing (upload, stock photos, AI-generated images)
  • Multi-platform social media management

4. Free Trial

We may offer a free trial period for new users. During the trial, you will have access to features as specified at the time of signup. When the trial ends, you must subscribe to a paid plan to continue using the Service. We reserve the right to modify or discontinue trial offers at any time.

5. Subscriptions and Billing

SocialBotify offers subscription plans billed on a monthly or annual basis. By subscribing, you agree to the following:

  • Recurring charges: Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
  • Payment: All payments are processed securely through Stripe. You must provide a valid payment method.
  • Price changes: We may adjust pricing with at least 30 days' notice. Existing subscriptions will be honored through the current billing period.
  • Plan changes: You may upgrade or downgrade your plan at any time. Changes take effect immediately, with prorated charges or credits applied.

6. Cancellation and Refunds

You may cancel your subscription at any time through your account settings or the Stripe billing portal. Upon cancellation:

  • You will retain access to the Service until the end of your current billing period
  • No partial refunds are provided for unused time within a billing period
  • Your data will be retained for 30 days after cancellation, after which it may be deleted

7. AI-Generated Content

SocialBotify uses artificial intelligence to generate social media content. You understand and agree that:

  • AI-generated content is created as suggestions and should be reviewed before publishing
  • You are solely responsible for all content published through your connected social media accounts
  • AI outputs may occasionally be inaccurate, inappropriate, or require editing
  • We do not guarantee that AI-generated content will achieve specific engagement or business results

8. Your Content and Data

You retain ownership of the content you create, upload, or publish through SocialBotify. By using the Service, you grant us a limited license to process, store, and transmit your content as necessary to provide the Service. This includes sharing content with third-party platforms you have connected.

9. Intellectual Property

The SocialBotify platform, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written consent.

10. Acceptable Use

You agree not to use SocialBotify to:

  • Publish spam, misleading, or deceptive content
  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Distribute harmful, abusive, or harassing content
  • Attempt to gain unauthorized access to the Service or its systems
  • Violate the terms of any connected social media platform

11. Third-Party Services

SocialBotify integrates with third-party services including social media platforms, payment processors, and AI providers. Your use of these services is subject to their respective terms. We are not responsible for the availability, accuracy, or policies of third-party services.

12. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any downtime or service disruptions.

13. Limitation of Liability

To the maximum extent permitted by law, SocialBotify and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will meet your specific requirements or that AI-generated content will be error-free.

15. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms will be resolved through good-faith negotiation, and if necessary, binding arbitration.
